At NOTE Cosmetics (“NOTE”, “we”, “us”, “our”), we value your privacy and are committed to protecting your personal information. This Privacy Policy explains what personal information we collect, how we use, share, store and protect it, and the choices and rights you have when you visit notecosmetics.com (the “Website”), sign up for our newsletter, contact us, or take part in our campaigns and giveaways.

2. Information We Collect

Information you give us:

Newsletter sign-up: your email address and country.
Messages and enquiries: your name, email address, phone number (if you provide it) and the content of your message.
Campaigns and giveaways: your social media username and, if you win, your name, contact details and delivery address, plus any other details the campaign rules ask for.
Business enquiries: contact and company details from distributors, retailers, press and partners.

Information collected automatically:

Device, browser and usage data, such as IP address, browser and device type, language, pages viewed and the website that referred you.
Approximate location (country or city) based on your IP address, so we can show retailers near you.
Information from cookies and similar technologies (see Section 6).

Information from others: when you interact with our accounts on Instagram, Facebook, TikTok, YouTube or LinkedIn (for example, by commenting, tagging us or sending a message), we receive the information your privacy settings on that platform make available.

We do not collect payment card details.

3. How We Use Your Information

We use your personal information only where we have a legal reason to do so:

To send our newsletter, product launches and offers, based on your consent.

We only send marketing emails if you have signed up for them. You can unsubscribe at any time by clicking the “unsubscribe” link in any of our emails or by writing to privacy@notecosmetics.com. After you unsubscribe, we keep only your email address on a suppression list so that we do not contact you again.

Our emails may contain small tracking pixels that show whether an email was opened and which links were clicked, which helps us improve our content.

Strictly necessary: to make the Website work and keep it secure. These cannot be switched off.
Functional: to remember your preferences, for example whether you have already seen our newsletter popup.
Analytics: to understand how visitors use the Website (for example, [Google Analytics]).
Advertising: to measure our ads and show you relevant NOTE ads on other platforms (for example, Meta Pixel).

Where the law requires it, we only use analytics and advertising cookies after you agree to them. Blocking some cookies may affect how the Website works.

7. International Transfers

NOTE operates internationally, and our service providers may process your data in countries other than your own, where data protection laws may differ. When we transfer personal data across borders, we use the safeguards required by applicable law, such as standard contractual clauses and, where required, your explicit consent.

8. Data Retention

We keep your personal data only for as long as necessary for the purposes described in this policy:

Newsletter: until you unsubscribe (after which only your email address is kept on a suppression list).

United States: if you live in a US state with a consumer privacy law (such as California), you may have the right to know, access, correct and delete your data, and to opt out of the “sharing” of your data for targeted advertising. Our Website and newsletter are not directed at children under 16, and we do not knowingly collect their personal data. If you believe a child has given us personal data, please contact us and we will delete it.
